Chen Fengchao Attending the Summary Conference about Sino-Germany Provincial/State Court Judge Exchange Program

 
On the afternoon of Dec. 16th, Chen Fengchao, Secretary of the Leading Party Members' Group & President of Hainan High People’s Court attended the Summary Conference about Sino-Germany Provincial/State Court Judge Exchange Program, reviewing the participation of Hainan Court in project activities and the experience and harvest, and hoping that in the future, there will be more opportunities to continue to perform more intensive exchange and cooperation with German judges in professional areas such as trial of international commercial affairs and judicial protection of intellectual property rights.

Chen Fengchao says that the rigorous and pragmatic spirit of German courts in judicial practices such as judicial review scope of arbitration, design of the civil enforcement system and cultivation of judges is of great reference value to us. At  the same time, the diversified mechanism for settling disputes promoted by Chinese courts is paid close attention to by peers of German courts. As an important guarantee for a law-based commercial environment, the diversified mechanism for settling international commercial affair disputes is being actively promoted by the Supreme People's Court for keeping on enhancing the international legal cooperation and mutual trust. Hainan Court is devoted to becoming a preferable place for settling international commercial affair disputes. Guided by the Supreme People's Court, it has established a “trinity” diversified mechanism for settling international commercial affair disputes, and realized seamless connection of three dispute solutions, i.e. conciliation, arbitration and litigation, dominated by the court.
Chen Fengchao introduced to the attendees the construction of Hainan Free Trade Port and relevant practices of Hainan Court. At present, Hainan is steadily advancing the construction of a free trade port with Chinese characteristics by steps and by stages. Hainan Court is actively assuming the mission and responsibility of judicial service and guaranteeing the construction of the free trade port. It has set the Intellectual Property Court of Hainan Free Trade Port, established a “three-review-in-one” trial mechanism integrated with civil litigation, administrative litigation and criminal litigation by relying on three advantages, i.e. specialized judicial organs, professional judicial personnel and professional judicial work, and strengthened the efforts about judicial protection of intellectual property rights. It has established a green channel of judicial service for investors, which can provide full-time, comprehensive and all-area “one-stop” online judicial credit services for Chinese and overseas investors so that they can inquire information about social credits, litigation and property attachment of cooperative partners. It has strengthened international judicial exchange and cooperation, and taking “the English website of Hainan High People’s Court” as a bridge, carried out normalized academic exchange activities with overseas judicial and academic institutions. In July this year, Hainan Court and Singaporean Academy of Law jointly sponsored an online training class about trial of international commercial affairs. In November, Hainan judges took an online participation in the international conference “European Union and Asia in a Digital World” and delivered a speech. In December, School of Law of University of Copenhagen of Denmark invited Hainan judges to teach online courses. All these activities have produced a good result.
It is known that ever since Hainan High People’s Court established friendly partnership with Supreme Court of Bavaria, Germany in 2015, they have carried out seven exchange activities in diversified forms and made plentiful achievements.
The conference was jointly sponsored by Supreme People's Court and GIZ through video connection. Zhou Qiang, chief grand justice of the People’s Republic of China & President of Supreme People's Court; Lin Peige, President of German Federal Supreme Court; representatives from German Embassy in China and principals of Robert Bosch Foundation attended the opening ceremony and delivered a speech. A total of 155 people, including leaders from judicial circles of both countries, judges and representatives of other aspects, attended the conference.
