Any dispute arising from or in connection with this Contract shall be exclusively and irrevocably submitted to Hainan First Foreign-Related Civil and Commercial Tribunal for litigation following the Chinese Civil Procedure Law.
Notice of the Model Clauses
1.The model clauses are applied to foreign-related contract disputes only, and shall not violate mandatory exclusive jurisdiction and hierarchical jurisdiction rules stipulated in Chinese Procedure Law.
2.Parties should be aware that exclusive jurisdiction is highly recommended to avail themselves of the extraterritorial judgment recognition and enforcement framework provided by the Hague Convention on Choice of Court Agreements.
3.Parties can agree on governing law concerning the dispute. Governing Law refers to substantive law only which excludes procedure law.
4.Parties can confirm the address of service for litigation in the clauses.
